Use of home match tickets

i) Subject to clause (iii) below, home match tickets are issued for your sole use and you shall not sell, assign or transfer these tickets, or any benefits assigned to it, to any other individual without the prior written consent of TUAFC. The reference to selling home match tickets includes offering to sell a home match ticket (including, without limitation, via any online auction website), exposing a home match ticket for sale, making a home match ticket available for sale by another and advertising that a home match ticket is available for purchase. For the avoidance of doubt (and by way of example only) home match tickets may not be offered as a prize in any promotion or competition; transferred, lent or sold to any third party as part of a hospitality or travel package; given to a third party who agrees to buy some other goods or services; or used for any other commercial purpose (all save as expressly authorised by the National League or TUAFC).

ii) The unauthorised sale or disposal of a home match ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. TUAFC will inform the police when it becomes aware that a home match ticket has been sold illegally and will press for charges to be brought against any individuals breaking this law. If you are convicted of a ticket touting offence, or the Club reasonably suspects you have committed such an offence, we will notify the National League who may in turn notify other clubs and/or the relevant law enforcement authorities. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details), and this will be used to identify and prevent ticket touting offences and disorder at football matches.

iii) If you are issued more than one home match ticket, one of these must be retained by you for personal use (subject to the provisions below), and the remainder may be transferred to your guest(s) for his/her/their personal use only, provided that any such transfer takes place in consideration of no payment or benefit in excess of the face value of the ticket, and such transfer does not take place in the course of any business, or for the purpose of facilitating any third party’s business. Any such transfer to guests will be subject to our Ticketing Terms & Conditions which will (save for any rights to transfer under this clause or any rights to a refund as stated in the clause listed below) apply to and bind each guest as if they was the original purchaser of this ticket (and you must inform the Guest(s) of this). You must provide the name and address of your guest(s) when asked to do so by any official, steward or employee of TUAFC and/or any police officer. In the event that you and/or your guest(s) are unable to use any home match ticket then you may transfer it to a natural person who is known to you personally and who would be entitled (under our Ticketing Terms & Conditions) to purchase home match tickets and attend home matches, again provided that any such transfer takes place in consideration of no payment or benefit in excess of the face value of the ticket, and any such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business. Such transfer will be subject to our Ticketing Terms & Conditions which will (save for any rights to transfer under this clause or any rights to a refund under the clause listed below) apply to and bind the transferee as if they were the original purchaser of the ticket (and you must inform the transferee of this). You must provide the name and address of the transferee when asked to do so by any official, steward or employee of TUAFC and/or any police officer.

iv) All home match tickets remain the property of TUAFC at all times, and must be produced together with evidence of your identity if required to do so by any official, steward or employee of TUAFC or any police officer. The Club reserves the right to require the immediate return of any home match ticket at any time.

v) Any home match ticket obtained or used in breach of our Ticketing Terms & Conditions shall be automatically void and all rights conferred or evidenced by any such home match ticket shall be nullified. Any person seeking to use a home match ticket in breach of our Ticketing Terms and Conditions in order to gain entry to the stadium or remain at a match may be considered to be a trespasser and may be refused entry to, or ejected from, the stadium in respect of a particular match and/or may have their home match ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause, no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit, in connection with any such matters, including a claim for an account of any profits made from an unauthorised use of a home match ticket.

Use of concessionary tickets

Any person entering or seeking to enter the Ground with a concessionary priced ticket in circumstances where such person is not entitled to such concession will be refused entry. In such case we will not make any refund in respect of any games remaining in the Season.

Unavailability of seats

The Club reserves the right, in its sole discretion, to allocate, on a temporary basis, an alternative seat anywhere in the Ground, including (but without limiting the circumstances when that discretion may be exercised):

(A) when the stand or part of the stand is closed for repairs, maintenance or re-building; or

(B) when the Club, the police or any other relevant authority otherwise considers it desirable in the interests of safety, crowd control or other Club requirements to re-allocate the seat.

(C) when there is social distance requirements set by the UK Government, Local Authorities, FA or National League.

As far as possible, details of any home matches at which there will be a re-allocation of the seat will be notified on the Website and, where practicable, in advance in the Club’s home match day programme.

If a fixture is placed on restricted sale and a supporter does not fulfil the eligibility criteria, the supporter will not be permitted to use another supporter’s details.

Social distancing: In the event of a pandemic and social distancing practices, the Club reserves the right to move any season ticket within the stadium. This is to ensure the safety of all of our supporters. It is up to the discretion of the Club to where the seat will be moved, although every effort will be made to find a seat of similar quality and value. In the event that a supporter has to be moved into a higher priced seat, that supporter will not be liable to pay the difference in seat prices.

Where a Match is required to be played Behind Closed Doors or with a reduced capacity (that affects your purchase) during the 2022/2023 season, as a consequence of a pandemic, through national jurisdiction or enforced by the English Football League, FA, UEFA or FIFA,  it will be our intention, subject to governing bodies permissions) that you will be provided, free of any charge, access to a streaming pass to view the fixture. Whilst we appreciate that not all supporters may wish (or be able to make use of) streaming services, there will be no price reduction or cash refund to a season ticket available in the event a fixture must be played behind closed doors. Please Note: Torquay United AFC does not endorse the livestreaming of football matches to public gatherings, and therefore does not authorise our livestreamed matches to be shown in any public venue.

Livestreaming: Any service offered will be subject to permission being granted by FIFA and / or any other relevant footballing authorities, as well as the competition’s broadcasting partners. If a match has been selected by live coverage by BT Sport, the Club is then not permitted to provide its own livestreaming service, and cannot be held liable for any recompense as a result of this.

Limitation of liability

The Club shall not be responsible for any interruptions and/or restrictions to the view of a match caused by virtue of the position of the seat and/or the actions of other spectators.

The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or for the Club’s fraud.

Except as otherwise set out in these Conditions, and to the fullest extent permitted by applicable law, the Club shall not have any liability in respect of any failure to carry out, or any delay in carrying out, any matter in respect of these Conditions, including admitting you to the Ground for a particular match, caused by any circumstances outside the Club’s reasonable control.
